

Rental Contract
The Packhouse Pop up Terms and Conditions Overview (updated on 28/05/25)
· Owner: Alison Hougham, trading as "The Packhouse Ltd", Hewett's Kilns, Tongham Road, Runfold, near Farnham, Surrey, GU10 1PJ ("The Packhouse").
· Trader: Refers to the person or entity renting the space.
· Premises: The building and grounds known as The Packhouse at the above address.
· Area: The specific outside area allocated to the Trader, known as The Pop-Up Shop, as detailed in the booking confirmation.
· Term: The agreed rental period as specified in each booking.
· Rent: The fee charged for each booking, as predefined online or in writing.
2. Trader Obligations
2.1 Insurance
· The Trader must maintain public liability insurance with a minimum cover of £2 million, and insure all goods and stock against fire, theft, and other risks.
· The Trader must provide a copy of their valid insurance certificate to the Owner prior to occupancy by uploading during the booking process online.
· The Owner’s insurance does not cover the Trader’s goods, stock, or liabilities.
2.2 Liability
· The Owner is not liable for any loss, theft, or damage to the Trader’s goods, nor for injury to the Trader, their staff, visitors, or customers, except for death or personal injury caused by the Owner’s negligence or fraud, or any other liability that cannot be excluded by law.
· The Owner’s total liability is limited to the sum received from the Trader for the relevant booking.
2.3 Area Maintenance and Use
· The Trader must keep the Area clean, tidy, and free from hazards, remove all refuse and advertising materials at the end of the Term, and return the Area in the same condition as received, allowing for fair wear and tear.
· Any damage caused by the Trader must be made good at their expense.
2.4 Subletting and Occupancy
· The Trader may not sublet, assign, or share the Area, nor permit more than the agreed number of persons to occupy it.
3. Booking, Cancellation, and Refunds
3.1 Booking Confirmation
· A booking is confirmed upon full payment and valid public liability insurance is provided.
3.2 Cancellation by Trader
· The Trader may cancel a booking by notifying desk@packhouse.com more than 14 days in advance for a full refund.
· Cancellations less than 14 days before the booking date are non-refundable.
3.3 Cancellation by Owner
· The Owner may cancel a booking at their discretion if the use is not in line with business values, poses a public safety concern, or due to circumstances beyond their control (including force majeure).
· In such cases, the Trader will receive a full refund, and the Owner will have no further liability.
3.4 Availability
· Bookings are made in good faith. If the Area becomes unavailable due to circumstances beyond the Owner’s control and no suitable alternative can be offered, the Trader will receive a full refund.
3.5 Refund Process
· Refunds will be processed within 14 days of cancellation confirmation.
4. Safety and Compliance
4.1 Legal Compliance
· The Trader must comply with all applicable laws and regulations, including health and safety, fire safety, and trading standards.
4.2 Electrical Equipment
· Only PAT-tested electrical equipment may be used. Certificates must be current and available for inspection.
4.3 Prohibited Activities
· The Trader must not bring hazardous, illegal, or flammable substances, portable heaters, or dangerous machinery onto the Premises.
· No trading is permitted in the car park or elsewhere on the Premises except within the designated Pop-Up Shop Area.
4.4 Conduct
· The Trader, their staff, and customers must not smoke or consume intoxicating substances that compromise safety.
· The Trader must not cause nuisance or annoyance to the Owner, staff, or other Traders.
4.5 Vehicles
· Any vehicles on site must be roadworthy and driven by licensed drivers. The Trader’s vehicle must be parked in the overflow car park for the day after unloading.
4.6 Alterations
· The Trader must not alter the Area without written permission from the Owner. Any alterations must be removed, and damage made good, at the end of the Term.
5. Conduct and Removal
· The Owner reserves the right to remove any Trader for damaging property, conduct detrimental to the well-being or comfort of others, or breach of contract.
· In such cases, no refund will be given.
· The Trader may appeal any removal decision in writing to the Owner within 48 hours.
6. Right to Alter Facilities
· The Owner reserves the right to alter, change, or improve facilities at any time.
· If facilities become unsuitable for the Trader’s intended purpose, the Owner will attempt to offer an alternative Area, subject to availability.
· No compensation will be provided if no alternative is available, but a refund will be given for the affected booking.
7. Data Protection
· Both parties agree to comply with all applicable data protection legislation (including UK GDPR) regarding any personal data exchanged under this agreement.
8. Governing Law and Jurisdiction
· This agreement is governed by the laws of England and Wales.
· Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
9. Acceptance
By paying the rental fee, the Trader acknowledges and accepts these terms & conditions and the responsibilities and risks outlined herein.
